Welcome to ERGO PURRCH™ (“ERGO PURRCH INC.”, “we”, “us”, “our”). By accessing our website and/or purchasing from us (the “Site” and “Services”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Site.
We may update these Terms from time to time. Your continued use constitutes acceptance of any changes.
Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell our products.
0. Shipping
Shipping terms, delivery times, and costs are governed by our Shipping Policy.
1. Eligibility & Use
You must be the age of majority in your jurisdiction (or have parental/guardian consent). You will not use the Site for unlawful purposes or in violation of any applicable laws.
2. General Conditions
We may refuse service to anyone for any reason. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our prior written consent. Section headings are for convenience only.
3. Security & Communications
Except for payment card data (encrypted in transit), transmissions over networks may be unencrypted. You consent to receive service-related communications electronically (email, in-app, or on-Site).
4. Site Content
Content is provided for general information and may not always be accurate, complete, or current. Historical information is for reference only. We may update content at any time without obligation to do so. Use of information is at your own risk.
5. Products, Availability & Pricing
Descriptions, pricing, and availability may change without notice. We make reasonable efforts to display colors and images accurately, but displays vary. Some items may be offered in limited quantities. Returns are subject to our Refund Policy.
6. Orders, Billing & Verification
We may limit or cancel orders (e.g., orders placed by or under the same account, card, or address). If we change or cancel an order, we may attempt to notify you via the contact details you provided. You agree to provide current, complete, and accurate purchase and account information and to promptly update it.
Pricing Errors
We reserve the right to correct errors or inaccuracies (including after an order is submitted). If a material pricing error affects your order, we may cancel and refund, or contact you to confirm at the corrected price.
7. Taxes, Duties & Import
Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any sales taxes, VAT/GST/HST, duties, import fees, brokerage, or other charges assessed by your jurisdiction or carrier, except where our Site explicitly states they are collected/remitted by us at checkout.
8. Shipping, Risk of Loss & Title
Risk of loss and title transfer to you upon our delivery of the items to the carrier (or upon delivery to you for orders where we offer local delivery). Delivery dates are estimates and not guaranteed. Please review our Shipping Policy for details and carrier claims process.
9. Pre-Orders & Lead Times
Pre-orders, backorders, and made-to-order items may have longer lead times. Estimated ship windows are provided as guidance and may change. You’ll be charged at checkout unless otherwise indicated. We may cancel and refund pre-orders we cannot fulfill.
10. Returns, Exchanges & RMAs
Return and exchange eligibility, time windows, condition requirements, and the RMA process are governed by our Refund Policy. Items returned without an RMA may be refused.
11. Optional Tools & Third-Party Links
We may provide access to third-party tools “as is.” Use them at your own risk and review the third party’s terms. Links to third-party sites do not imply endorsement; we are not responsible for their content or policies.
12. Accounts & Acceptable Use
You are responsible for safeguarding your account credentials and for activities under your account. You will not:
- interfere with or circumvent security features of the Site,
- upload or transmit malicious code,
- harvest data or scrape without permission,
- infringe intellectual property or privacy rights,
- use the Site to harass, abuse, or harm others.
We may suspend or terminate access for violations.
13. Feedback & User Content
If you submit comments, ideas, or feedback, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use and exploit them for any purpose without obligation to you. You represent that your submissions do not violate any law or third-party rights.
14. Intellectual Property
All content on the Site—including text, images, graphics, logos, product designs, and software—is owned by ERGO PURRCH INC. or its licensors and protected by intellectual property laws. Unauthorized use is prohibited.
ERGO PURRCH™ and associated branding and product designs are protected trademarks and intellectual property. We actively monitor infringement and may take legal action. Report suspected infringement to support@ergopurrch.com
15. Privacy
Your submission of personal information is governed by our Privacy Policy and any incorporated notices (e.g., cookie disclosures).
16. Promotions, Gift Cards & Discounts
Promotions, offers, and discount codes are subject to their stated terms, may not be combined unless expressly allowed, and may be modified or withdrawn at any time. Gift cards are subject to the terms presented at purchase and applicable law.
17. Warranty Disclaimer
To the fullest extent permitted by law, the Site, Services, and all products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. Some jurisdictions do not allow limitations on implied warranties; your rights may vary.
18. Limitation of Liability
To the fullest extent permitted by law, ERGO PURRCH INC., its directors, officers, employees, affiliates, agents, contractors, suppliers, or licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenues, savings, data, or goodwill, arising out of or related to your use of the Site or products, even if advised of the possibility. Our total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim, or CAD $100 if the claim does not relate to a purchase. Some jurisdictions do not allow certain limitations; your rights may vary.
19. Indemnity
You agree to indemnify and hold ERGO PURRCH INC. and its affiliates, officers, directors, employees, and agents harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
20. Export, Sanctions & Geographic Restrictions
You represent that you are not located in, under the control of, or a national/resident of any country or person subject to trade sanctions or export restrictions. You agree to comply with all applicable export control and sanctions laws.
21. Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including acts of God, labor disputes, supply or transport disruptions, epidemics, governmental actions, or failures of suppliers or carriers.
22. Severability, Waiver & Assignment
If any provision is held invalid, the remainder remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
23. Governing Law & Venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the courts located in Ontario, Canada.
24. Entire Agreement
These Terms, together with the policies referenced herein (Shipping, Refund, and Privacy), constitute the entire agreement between you and ERGO PURRCH INC. regarding the Site and products and supersede prior agreements.
25. Changes to Terms
We may update these Terms at any time by posting a revised version on the Site and updating the “Last updated” date. Your continued use after changes become effective constitutes acceptance.
